Brief Considerations on Regulation (Eu, Euratom) 2024/2019 Concerning the Allocation of Tasks from the Court of Justice, in Certain Specific Areas, to the General Court of the European Union

In this paper we wish to analyze the new provisions of the Regulation Regulamentului (UE, Euratom) 2024/2019 of the European Parliament and of the Council from April 11, 2024 amending Protocol No. 3 on the Statute of the Court of Justice of the European Union. Due to the large number of preliminary cases pending and increasing the average duration of their examination, for better administration and effectiveness of Union justice, after receiving the opinion of the European Commission, the Court of Justice requested transfer of a category of preliminary jurisdiction to the General Court. The Court of Justice reserved for examination only those requests for a preliminary ruling which are "more complex and sensitive". As a result, we aim to analyze what are the benefits of this transfer of competence from the Court of Justice to the General Court. This research topic, which falls within the theme of the conference, will be investigated through the logical, comparative and historical method, as methods of legal scientific research.
