Abstract

Democracy, development, and integration are key forces shaping modern society. However, democracy cannot thrive in a country where human rights and freedoms are not respected. Similarly, social development and integration must not undermine the foundations of democracy in a state governed by the rule of law. Technology has become the driving force of social progress, increasingly merging human life with contemporary advancements. People are now highly dependent on technology and social media, spending a significant portion of their time online. At the same time, artificial intelligence has advanced rapidly, enabling instant access to information, seamless global communication, and efficient task completion. However, technological progress has not come without drawbacks. This rapid development has raised concerns about fundamental rights, particularly in relation to Article 8 of the European Convention on Human Rights (ECHR). The widespread use of AI has led to serious privacy violations, resulting in unlawful interference in private life. Minors represent the most vulnerable group when it comes to violations of personal data privacy. To guarantee their best interests, state intervention is essential. While artificial intelligence provides countless opportunities for children, it also significantly increases the risk of infringing on their rights.Governments have attempted to address this issue through various projects and political initiatives aimed at providing effective solutions. However, these efforts have largely resulted in fragmented actions without concrete implementation. Policymakers are continuously exploring ways to ensure the safe use of artificial intelligence by children, but so far, no security framework has been successfully established. This ongoing uncertainty has deeply unsettled social policies, leading to instability and failing to produce a definitive solution to this growing concern. The Albanian state has ratified international conventions that safeguard individual privacy. However, to this day, there is no dedicated legislation that protects personal data from the risks posed by artificial intelligence, particularly concerning children. The recommendations stem from the urgent need for the Albanian state to establish dedicated legislation, as the rapid pace of technological advancement continues to threaten the right to protection from unlawful interference in private life.
